The California Consumer Privacy Act is the strongest privacy law in the United States. It gives Californians rights that most Americans don't have: the right to know what data companies collect about them, the right to delete it, the right to opt out of its sale, and the right to non-discrimination for exercising those rights.

In 2026, AI systems are the primary mechanism by which personal data is collected, analyzed, and monetized. And CCPA — even after its 2020 expansion (CPRA) — was not designed for a world where your data doesn't live in a database.


What CCPA/CPRA Actually Gives You

The California Consumer Privacy Act (2018, effective 2020) and its strengthening amendment, the California Privacy Rights Act (2020, effective 2023), together provide:

Right to know: Californians can request what personal information a business has collected about them, where it came from, and how it's used.

Right to delete: Californians can request deletion of personal information. Businesses must delete and direct service providers to delete.

Right to correct: Californians can request correction of inaccurate personal information.

Right to opt out of sale or sharing: Californians can opt out of the sale or sharing of their personal information for cross-context behavioral advertising.

Right to limit sensitive data use: Californians can limit the use of sensitive personal information (Social Security numbers, financial data, health data, precise geolocation, racial/ethnic origin, religious beliefs, biometrics, sexual orientation, communications content).

Right to non-discrimination: Businesses can't penalize Californians for exercising these rights.

For businesses collecting data the traditional way — rows in a database, profiles in a CRM — these rights are meaningful and increasingly enforceable. The California Privacy Protection Agency (CPPA), created by CPRA, has enforcement authority and has begun issuing fines.


How AI Breaks Every One of These Rights

The "Right to Know" Problem

Ask an AI company what personal information they have about you. They'll provide a data export: your account information, your conversation history (if stored), your payment details.

What they won't tell you: what the model has learned about you. The behavioral patterns extracted from your interactions. The inferences made about your interests, psychology, emotional state, and decision-making patterns. The clusters you've been assigned to for targeting purposes.

CCPA's right to know applies to "personal information" as defined by the law. That definition includes inferences "drawn from any of the information identified in this subdivision to create a profile about a consumer reflecting the consumer's preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes."

This is actually good language. Inferences are covered.

Except: AI companies routinely argue that the behavioral inferences embedded in model weights aren't a "profile about a consumer" — they're model parameters. The model doesn't have a John Smith profile. It has weights that cause certain outputs when given John Smith-like inputs. Lawyers are still sorting out whether this distinction holds up.

The "Right to Delete" Problem

This is the fundamental incompatibility between privacy law and AI architecture, described in detail in our training data investigation: you cannot delete from model weights.

If an AI company has trained a model on your conversation history, your social media posts, your purchase data, or your behavioral patterns — deleting the underlying data doesn't remove what the model learned from it. The model itself encodes that learning as billions of floating-point numbers.

CCPA's deletion right requires businesses to delete personal information from their records. It does not — because it cannot — require them to retrain their models. The CPPA's draft regulations acknowledge this challenge and have not resolved it.

Some companies offer "conversation history" deletion — meaning they'll stop storing your chat logs. The model trained on millions of conversations like yours remains unchanged.

The "Right to Opt Out of Sharing" Problem

CCPA lets you opt out of the "sale or sharing" of your personal information for cross-context behavioral advertising.

AI systems have invented new mechanisms for monetizing behavioral data that may not qualify as "sale" or "sharing":

Model training: Your data trains a model. The model is used commercially. Your data wasn't "sold" — it was internalized. Is training a form of sharing? CCPA doesn't say.

API-based inference: Your behavioral profile isn't sent to an advertiser. Instead, advertisers use an AI API to run queries against a model trained on your data. The data wasn't shared — the model was queried. Legally distinct, functionally equivalent.

Synthetic data generation: Your data is used to generate "synthetic" data that statistically mirrors your real data but isn't technically your data. That synthetic data is then sold. You can't opt out of your synthetic clone.

The "Sensitive Data" Problem

CPRA created heightened protections for sensitive personal information — requiring opt-in consent for its use. The sensitive categories include health data, biometrics, racial/ethnic origin, communications content, and precise geolocation.

AI systems routinely infer sensitive category data without collecting it directly:

  • Shopping patterns infer health conditions (the Target pregnancy prediction problem at AI scale)
  • Writing style, word choice, and topic selection infer mental health status, political views, and religious beliefs
  • Gait patterns from location data infer disabilities
  • Voice patterns infer emotional state, stress levels, potential neurodivergence

Inferred sensitive data occupies a gap: it was derived, not collected. CPRA's sensitive data protections apply to data you provided. The inference extracted from that data may not qualify.


The "Public Information" Loophole

CCPA exempts "publicly available information" from most of its requirements. Information you've made public — posts, public social media profiles, publicly recorded transactions — isn't covered.

AI companies use this exemption aggressively. Your public LinkedIn profile isn't subject to deletion rights. Your public tweets aren't subject to opt-out requirements. Your publicly filed court records, property records, and business filings aren't protected.

AI-powered data brokers aggregate these public sources and build behavioral profiles that are anything but innocuous. The individual pieces are public. The combined profile — your financial situation, relationship status, employment history, public statements, movement patterns reconstructed from public check-ins — is sensitive.

CCPA's public information exemption was designed for a world where individual public facts were genuinely public in a limited way. In the age of AI, combining public facts at scale creates private facts that the subject never intended to make available.


The "Service Improvement" Exemption

CCPA has a service improvement exemption: businesses can use consumer data to improve the services they provide to that consumer, without it counting as a "sale."

AI companies have interpreted this broadly: using your data to train models that provide better responses to you (and everyone else) qualifies as "service improvement."

Under this reading, virtually any use of your data for model training is exempt from sale/sharing restrictions — as long as the improved model is eventually used in the service you consume. You can't opt out. The training just continues.

The CPPA has signaled interest in tightening this exemption for AI contexts, but as of 2026 it remains permissive.


Automated Decision-Making: The Right That Doesn't Exist Yet

CPRA included a provision directing the CPPA to establish regulations giving consumers "the right to opt out of automated decision-making technology, including profiling" in certain contexts.

The CPPA has been working on these regulations since 2023. They are still not final in 2026. Six years after CPRA passed, Californians do not yet have a workable right to opt out of automated decisions affecting their employment, credit, housing, education, or healthcare.

This matters enormously. AI systems are increasingly making or influencing these decisions. Loan approvals, job applications, insurance pricing, content moderation, bail recommendations — all affected by automated profiling. The right to contest these decisions, to know they exist, to opt out of the profiling that feeds them: CPRA promised this. The CPPA hasn't delivered it.


What CCPA Gets Right

It would be wrong to dismiss CCPA/CPRA. Relative to the federal baseline (essentially nothing), it is meaningful:

Enforcement with teeth: The CPPA can fine up to $2,500 per unintentional violation, $7,500 per intentional violation. For large-scale violations affecting millions of Californians, this is real money.

Data broker registration: California requires data brokers to register with the state. The Delete Act (2023) will require data brokers to honor deletion requests through a centralized interface — a significant practical improvement.

Sensitive data categories: CPRA's sensitive data framework is better than most US equivalents. The intent is right even where implementation lags.

Private right of action (limited): For data breaches involving certain categories of information, Californians can sue directly without waiting for CPPA enforcement.

Model for other states: CCPA triggered a cascade — Virginia, Colorado, Connecticut, Texas, and a dozen other states have passed their own privacy laws. California set the standard.


The Fundamental Problem

CCPA was designed to give consumers control over their personal data. The implicit model: your data is a thing, stored in a place, and you should be able to see it, delete it, and restrict its use.

AI has changed what personal data means. Your data isn't primarily stored in rows anymore — it's embedded in model weights, encoded in behavioral profiles, instantiated in inference systems that can reconstruct facts about you that you never directly provided.

A law built on the database model of personal data cannot fully govern the AI model of personal data without substantial extension. The concepts — right to know, right to delete, opt-out of sale — need translation for an architecture where "your data" doesn't have a clear boundary.

The translations needed:

  • Right to know what was inferred, not just what was collected
  • Right to delete from model weights (requiring machine unlearning investment)
  • Inference opt-out — not just data sale opt-out
  • Finalized ADM rules — the automated decision-making regulations that are six years overdue
  • Training data consent — a lawful basis requirement for using personal data in model training

California is the only US state attempting to govern AI privacy at this level. The CPPA is actively working on AI-specific regulations. The direction is right.

It's just not fast enough for the AI systems being deployed right now.


What Californians Can Actually Do Today

Submit deletion requests: Use CCPA deletion rights for every AI company that holds data about you. Even if model weights can't be purged, stored conversation history, account data, and behavioral profiles in databases can be.

Opt out of data sales: Use the Global Privacy Control (GPC) browser extension. CCPA requires businesses to honor GPC signals as opt-out requests. Most major AI companies have implemented this (to varying degrees of completeness).

Request your data: Understanding what a company actually holds about you is the first step. Request data exports from every AI service you use.

Limit sensitive data use: For AI services, exercise your CPRA right to limit the use of sensitive personal information. This may restrict certain features but also restricts training data.

Contact the CPPA: If a business violates CCPA, file a complaint with the California Privacy Protection Agency. The CPPA is actively investigating.

Support the ADM regulations: The automated decision-making rules are still being finalized. Public comment periods matter — participate.


The Bigger Picture

California's privacy law is the best available protection for AI-era privacy in the United States. It is being outpaced by the AI systems it was theoretically designed to govern.

The gap between what CCPA promises and what it delivers for AI privacy isn't a failure of California lawmakers. It's a structural problem: AI architecture doesn't fit the conceptual model privacy law was built on. The right to delete a database row is straightforward. The right to remove your behavioral signature from a neural network is an unsolved research problem.

Until the law catches up to the architecture — or until AI companies are required to build systems that can actually honor privacy rights — CCPA is the best available shield against a threat it was not designed to stop.

That's not nothing. But it's not enough.
